All There is to Know on the Workmen’s Compensation Act 

The original enactment of Workmen’s Compensation Act was passed in 1975 and revised in 2009. This act, also known as the Work Injury Compensation Act (WICA), falls under the category of commercial insurance Singapore.

What is Work Injury Compensation Act?

WICA or Work Injury Compensation Act is the government law that enables employees to make claims for the injuries suffered as a direct result of their line of work, circumventing the procedure of handling the issue through the common law by filing a civil law suit. This procedure simplifies the process of availing compensation and enables quicker settlement for the damages incurred.

Who is covered under WICA?

This act remains valid for all employees of a certain establishment regardless of their salary. The employee can either be under a contract of apprenticeship or service. Contract of Service is the agreement between the employer and the employee in which both parties agree to take on their respective roles as administrator and worker and the latter agrees to professionally serve the former to the best of their capacity. This agreement need not necessarily be written down; a verbal exchange will also suffice. An appointment letter seals this agreement. In order to negate future complications between the two parties, a written document in most cases is attested by both.

However, WICA does not cover:

  1. Domestic workers
  2. Self-employed or independent contractors
  3. Those who are uniformed like the Singapore Police Force, Singapore Arms Force, Central Narcotics Bureau, Civil Defense Force and Singapore Prison Service.

What can be claimed?

There are three types of claims that can be made:

  1. Medical expenses: The employee is bound to pay for all the work related accidents to a maximum limit of $36,000 or for a year from the date of accident, whichever comes first. Bills that can be claimed are ward charges, consultation fees, report fees, medicine cost, etc. Cost of physiotherapy can also be claimed provided the treatment is recommended by the doctor.
  2. Medical leave wages: Payment is made only on doctor’s recommendation for only working days.
  3. Lump sum compensation: The family of the injured can claim for a lump sum amount in the case of a serious accident that incapacitates the employee or death.
